1. Provider and license
Hummingbird Season is provided by dvainsolutions. The app license is governed by the Apple Standard EULA and applicable App Store terms. These Terms explain the app’s use and informational limitations; they do not replace Apple’s Standard EULA or reduce mandatory consumer rights. Use the app lawfully and in accordance with that license. If local law requires parental or guardian permission, obtain it before use.
2. Purchase
Hummingbird Season is an upfront-paid app. The price and any applicable taxes are shown by Apple before purchase. The current app has no in-app purchases, subscriptions, or recurring charges. Apple processes payment, redownloads and refund requests under its applicable terms and local law. These Terms do not limit any statutory cancellation, refund or other consumer rights. Buying the app is not a promise of specific future features or indefinite updates.
3. Typical seasonal information
Regional calendars describe broad, typical seasonal patterns from cited sources, not live sightings, bird identification, migration tracking or exact arrival forecasts. Timing varies by species, location, weather and year. Some guides describe year-round residents; others have no seasonal calendar. A country or area on the map does not imply complete local guide or date coverage. The map is not a navigation or wildlife-location service. Check the app’s sources and current local guidance before relying on the information.
4. Feeder care and wildlife
Nectar and cleaning information is general educational guidance. A daily check reminder is not a guarantee that nectar is safe until the reminder or a substitute for inspecting and caring for a feeder. Conditions such as heat and contamination can require earlier action. Follow current guidance from qualified wildlife organizations and applicable local rules. Do not disturb birds, nests or protected habitats. The app does not guarantee bird visits, wildlife health or feeding outcomes.
5. Your records and reminders
You retain rights to your own notes and records. You decide what to save and can edit or delete records in the app. Records are local; there is no developer-operated cloud backup, sync or journal export. Device backups depend on iOS settings. We cannot recover records we never receive. iOS controls notification delivery and widget refresh; power settings, permissions and system conditions may delay or prevent updates and reminders. Do not rely on a notification as the only way to remember necessary care.
6. Offline use and external links
Core features work offline after installation. Scientific references and other external websites require internet access and are governed by their operators’ terms and privacy policies. We do not control their availability or content. App updates, downloads and Apple services can also require internet access.
7. Intellectual property and privacy
The app’s original software, design and artwork belong to their respective rights holders. Third-party sources, data and materials retain their own rights and attribution requirements. 8. Availability, responsibility and your rights
We aim to provide useful, accurate information but cannot guarantee complete coverage, uninterrupted operation, error-free data or particular wildlife outcomes. Features and information may change through updates. Subject to mandatory law and Apple’s Standard EULA, the app and educational content are provided as available, and we are not responsible for indirect or consequential loss caused by reliance on estimates or missed reminders. Nothing excludes liability that cannot lawfully be excluded, including applicable liability for fraud, intentional misconduct, gross negligence, or death or personal injury, or limits statutory warranties, remedies or consumer protections.
9. Stopping use and changes
You can stop using and delete the app at any time. License termination is governed by Apple’s Standard EULA; the app has no remote account to close. We will post updated Terms here with their effective date and provide any additional notice or consent required by law. Mandatory protections and access to courts under the law applicable to you remain unaffected.
