Privacy Policy for Elf Maker

Effective date: November 1, 2025

This Privacy Policy explains how Dvain Solutions ("we", "us", "our") collects, uses, and protects information when you use the Elf Maker mobile application ("App").

1) Information We Collect

Images and Face Data You Choose to Upload

  • Only the photos you explicitly select are processed. These photos may contain facial features and biometric data (face data).
  • Images containing face data are prepared locally on your device and then sent via our secure proxy to our AI processing provider (OpenAI) to generate the elf transformation.
  • We do not collect or extract biometric identifiers separately from the images you provide. Face data is contained within the images you choose to upload.

Subscription Status

  • We receive non-sensitive entitlement information (e.g., active/expired) from RevenueCat. We do not receive full payment details.

Analytics and Diagnostics

  • Basic, non-identifying diagnostics (feature usage, crashes) and generic device info (model, OS version) to improve reliability.

2) How Your Images and Face Data Are Used

Face Data Collection and Use

  • Collection: Face data is collected only when you explicitly choose to upload a photo containing facial features. We do not automatically detect or collect face data from your device.
  • Purpose: Face data is used solely to generate the requested elf transformation while keeping the person's face recognizable in the transformed image.
  • On-device processing: Selected photos containing face data are resized and optimized locally on your device before transmission.
  • Cloud processing: Images containing face data are transmitted to OpenAI's API through our secure Cloudflare Worker proxy solely to generate the transformation. The transformation process requires face data to create a recognizable elf version of the person in the image.
  • Storage: Transformed images (which may contain face data) and original images are stored locally on your device for your in‑app gallery. Images are saved to your Photos library only if you tap Save to Photos.
  • Servers: We do not persist images containing face data on our servers. OpenAI processes your images transiently (see Third‑Party Services and Data Retention sections).

3) Subscriptions, “Unlimited” Access, and Fair Use

Premium subscriptions advertise “unlimited” access; unlimited generations are subject to fair use and may be throttled to prevent abuse.

4) Third‑Party Services

OpenAI (Image Processing)

  • Purpose: Generate the elf transformation you request. Images containing face data are shared with OpenAI to perform this transformation.
  • Transport: We proxy requests through our serverless Cloudflare Worker; your OpenAI key is not embedded in the app.
  • Face Data Sharing: Images containing face data are transmitted to OpenAI's servers for processing. OpenAI processes these images according to their privacy policies and data usage policies.
  • Policies: See OpenAI's Privacy Policy and API Data Usage Policies for information about how they handle face data.

RevenueCat (Subscriptions)

Apple (App Store & Photos)

  • Payments are handled by Apple. Photos access is requested only to save images when you choose to do so.

5) Legal Bases (EEA/UK)

  • Performance of contract to provide requested transformations.
  • Legitimate interests for reliability, abuse prevention, and analytics.
  • Consent for Photos library access.

Face Data Retention

  • Device storage: Images containing face data remain on your device until you delete them from the in‑app gallery or Photos library. You have full control over when to delete these images.
  • Server processing: Images containing face data sent to OpenAI are processed transiently for the purpose of generating the transformation. According to OpenAI's API Data Usage Policies, images are not used to train OpenAI's models and are deleted after processing. We do not retain images containing face data on our servers.
  • Third-party retention: Face data shared with OpenAI is subject to OpenAI's data retention policies as described in their API Data Usage Policies. We do not control OpenAI's retention periods.
  • Entitlements/diagnostics: Retained only as long as necessary for the purposes above.

7) Children’s Privacy

ElfMaker is not directed to children under 13 (or the minimum age in your jurisdiction). Do not use the App if you are under the applicable age.

8) Your Choices

  • Manage Photos permissions in iOS Settings.
  • Delete images from the in‑app gallery and Photos at any time.
  • Cancel subscriptions via the App Store.

9) Security

We use encryption in transit, least‑privilege access, and serverless secret management. No method is 100% secure.

10) International Transfers

Processing may occur on infrastructure outside your country. We use providers with appropriate safeguards.

11) Changes
